BOP officials and wardens use objective criteria and a point system to assess risk and would keep doing so under the new law before granting early release.

The BOP has never followed the law on early release and it certainly does not use an objective system or points to make its decisions. Rather, the early release decisions are entirely at the whim of the wardens and higher-ups who must approve early release. Last I heard, their propensity to deny obviously required releases had got to the point that there was talk of taking these decisions away from the BOP.
